1 - REGULATION OF THE TRAVEL CONTRACT

These General Conditions apply to all travel contracts concluded with Enjoylive Travel s.r.l. and/or Alderans S.r.l. (Noteinviaggio). In the case of a travel contract for the purchase and sale of a 'tourist package', the rules set out in Legislative Decree no. 79/2011 (so-called 'Tourism Code', as amended by Legislative Decree no. 62 of 21 May 2018, transponsting and implementing by the EU Directive 2015/2302) will also apply, while in the case of the intermediation of a single tourist service, the rules applicable will also be those set out in Law no. 1084 of 27/12/1977 (ratification and execution of the International Convention on Travel Contracts, so-called CCV).

2 - BOOKING PROCEDURE AND CONCLUSION OF THE TRAVEL CONTRACT

Reservation requests can be made: by phone at +3 0721/287282 or +39 06 3220657, or by e-mail at info@italiainscena.com. The travel contract will be considered concluded when Enjoylive Travel s.r.l./Alderans S.r.l. sends confirmation of the booking by fax or e-mail.

3 - PRICES AND TOURIST TAX

The prices published on the website www.italiainscena.com and/or indicated in the travel contract proposal, unless otherwise specified, are per person. Any changes in prices may occur in cases of application of costs, taxes and/or duties not foreseen at the time of conclusion of the travel contract, as well as in cases of changes in exchange rates. The tourist tax (where applicable) is never included in the prices and must be paid by the customer directly at the hotel / services supplier.

4 - PAYMENTS

The payment for the package/service must be made by bank transfer and/or credit card according to the terms and conditions indicated by Enjoylive Travel/Alderans S.r.l. in the travel contract proposal or in the booking confirmation. A copy of the payment must be sent (by fax or e-mail) to Enjoylive Travel s.r.l./Alderans S.r.l.. In the absence of such information, the full amount of the travel contract payment must be paid no later than 30 days prior to the customer's departure. The payment term indicated above shall be considered essential and failure to comply with the same shall entitle Enjoylive Travel s.r.l./Alderans S.r.l. to declare the cancellation of the travel contract by sending a simple written declaration.

5 - TRAVEL DOCUMENTS (VOUCHER /AND OR TICKETS)

Travel documents will be sent by Enjoylive Travel s.r.l./Alderans S.r.l. (by e-mail or postal service or shipping) only after receiving payment of the full amount due from the customer.

6 - TRAVEL INTERRUPTION

If the customer decides, for any reason, to leave the booked accommodation before the date of departure, Enjoylive Travel s.r.l./Alderans S.r.l. cannot be asked for any refund for nights and services not used, unless such refund is expressly authorized and recognized by the services supplier. In this case Enjoylive Travel s.r.l./Alderans S.r.l., having received the refund from the hotel, will refund the corresponding amount to the customer.

7 - WITHDRAWAL BY THE TRAVELLER

Admission tickets to museums, musical, theatrical or sporting events are in no case refundable and the customer must also bear any expenses incurred by Enjoylive Travel s.r.l./Alderans S.r.l. for the purchase of the same. No refunds will be granted even in case of no-show or delayed presentation at the event. Some tourist services may be subject to different penalties, which will eventually be communicated in the booking confirmation. In case of withdrawal of the customer after the conclusion of the travel contract, the following conditions will apply. The conditions set forth in this paragraph will apply in case of withdrawal of the traveler for any reason and/or cause (including, by way of example and not limited to, illness of the same, inability to reach the destination due to strike of the transport carriers or for other reasons, adverse weather conditions, restrictions decided by the competent authorities, epidemics, war events, civil and military unrest, riots, disasters, looting, acts of terrorism, etc. ... etc.).

8 - EVENTS: CONCERTS - SPORTING AND THEATRICAL EVENTS - CHANGES OR CANCELLATION

Enjoylive Travel s.r.l./Alderans S.r.l. will not be held in any way responsible if, after the conclusion of the travel contract, the musical, theatrical or sporting event, or access to the museum, possibly included in the travel package, should be subject to changes compared to the official program (by way of example and not exhaustive: modification of the date, venue or calendar of the event, forfait or replacement of an artist, etc. ...). The customer acknowledges and accepts that events involving the performances of artists (singers, opera concerts, sports, etc. ...) may be subject to change and / or cancellation for reasons beyond the control, respectively, of the organizers and / or Enjoy Travel s.r.l./Alderans S.r.l. and therefore, by purchasing the package, the customer declares and agrees to assume the full economic risk (direct or indirect) of cancellation, displacement and / or modification of the event. For these reasons, the customer who intends to withdraw due to the above mentioned variations of the event or who should see the event cancelled for the above reasons, will not be refunded the ticket, nor will any other amount be returned. Furthermore, in case of cancellation of the event by the supplier, Enjoylive Travel s.r.l./Alderans S.r.l. will comply with the economic conditions that will be established by the supplier and, if the supplier expressly authorizes the refund of the ticket, once this refund has been made, only the face value of the ticket will be refunded, to the exclusion of any other compensation and/or return.

9 - CHANGES AND CANCELLATION OF THE TOURIST PACKAGE BY THE ORGANIZER

The Organizer reserves the right to unilaterally modify the conditions of the tourist package, other than the price, if the modification is of little importance. Enjoylive Travel s.r.l./Alderans S.r.l. may also cancel the contract, in whole or in part, without payment of any compensation and/or refund, if unforeseeable, extraordinary and/or force majeure circumstances occur (by way of example only: strikes, adverse weather conditions, restrictions decided by the competent authorities, epidemics, war events, civil and military unrest, riots, disasters, looting, acts of terrorism, etc.).

10 - COMPLAINTS AND DENUNCIATIONS

Any defects in the execution of the contract must be contested by the traveller without delay; in the absence of such a complaint the compensation for damages will be reduced or excluded pursuant to art. 1227 of the Italian Civil Code. The traveler must also - under penalty of forfeiture – send a complaint by registered letter with return receipt, or by pec to esatourmusic.pec@legalmail.it, to be sent no later than ten working days from the date of return to the place of departure.

11 - HANDLE

It is understood that Enjoylive Travel s.r.l./Alderans S.r.l. shall be held harmless and indemnified from any question, claim and/or request of the traveler that, due to all the above conditions, does not concern an exclusive responsibility of the latter, but is directly or indirectly related to a fact of the organizer/supplier or derives from causes that can be qualified as extraordinary, unforeseeable and/or force majeure or, in any case, not dependent on Enjolive Travel s.r.l./Alderans S.r.l..

12 - INSURANCE

Pursuant to art. 47 of Legislative Decree no. 79 of 23.05.2011 (so-called Tourism Code) Enjoylive Travel s.r.l./Alderans S.r.l. declare that for the performance of tour operating activities it is covered by Groupama insurance policy UnipolSai Ass.ni n.1/72930/319/178471709.

13 - APPLICABLE LAW - PLACE OF JURISDICTION

All disputes that may arise as a result of the conclusion, execution and interpretation of travel contracts will be governed exclusively by Italian law and the competent court in relation to them will be exclusively that of Pesaro.
